

Two men accused of murder appeared in court today for their preliminary hearings. 27-year-old Robert L. McDonald is charged with murder, and 22-year-old Aundre Tubbs is charged with murder and possession of a stolen weapon, in the fatal shooting of Demetrius Burge. Burge was fatally shot on September 29 in front of a store on 17th Avenue. Tubbs waived his right to a preliminary hearing. During McDonald’s preliminary hearing, detectives told the judge that Tubbs and McDonald were walking into the store when Burge drove up. They said some words were exchanged before Tubbs pulled a gun and shot Burge five times, killing him.
Although detectives said McDonald didn’t have a gun, they believe he and Tubbs acted together. They said McDonald may have been seeking retaliation after Burge shot him five times a week prior. The judge decided there was probable cause to believe McDonald participated in the crime and set bond at $250,000.
